Safety Protocol Agreement

Liability Waiver

By registering for this program , I AGREE & ATTEST to all the following, on behalf of myself named herein as a participant in this program or any minor participant (s) mentioned herein that I represent and am legally responsible for.

 

I am aware of the risk of Covid-19 associated with participating in any in-person experience, including all ART 101 Art Classes & Programs I will NOT attend this program mentioned herein if I am currently experiencing symptoms of fever, fatigue, difficulty breathing, or dry cough or exhibiting any other symptoms relating to COVID-19 or any communicable disease, or have experienced/exhibited any of these symptoms within 14 days of this event.

 

I AGREE on behalf of myself as the participant or participants named herein to agree to hold harmless, release, waive and indemnify ART 101 NY LLC, its members, employees, agents, successors and assigns to any & all injuries, illness, medical conditions, claims, liabilities, damages, expenses or judgments from participation in any and all ART 101 programming and/or activities, including use of the area(s) and/or equipment, participation in a class or program at ART 101 NY LLC Any defense, cost or expense arising out of any and all claims, injuries, liabilities or damages arising out of or related to participation in any and all of our programming, as set forth, including attorneys’ fees

 

I CERTIFY the information that I have entered herein to be accurate and true. I am at least 18 years old and I have read and agree to the terms of this agreement.

Terms of Agreement

I AGREE that I and any participant(s) named above shall comply with all of ART 101’s terms, signs, rules and written & verbal instructions of ART 101 staff as conditions for entry and participation into any Class, including the Rules of ART 101 & Safety Restrictions set forth on our website.

I, on behalf of myself and the participant(s) named here, our heirs, assigns, representatives, and next of kin, agree to hold harmless, release, waive and indemnify ART 101 NY LLC, its members, employees, agents, successors and assigns from (A) Any & all injuries, illness, medical conditions, claims, liabilities, damages, expenses or judgments from participation in any and all ART 101’s programming and/or activities, including use of the area(s), play/climbing structure(s) and/or equipment, participation in a class, program or event offered at ART 101 (B) Any defense, cost or expense arising out of any and all claims, injuries, liabilities or damages arising out of or related to participation in any and all of our programming, as set forth, including attorneys’ fees.

Class Time

All students are expected to arrive on time. Classes start and end at the advertised times. If a student arrives late, they will NOT be given extra time at the end of class to finish their project.

Drinks + Snacks + Personal Belongings *

Please DO NOT SHARE any personal belongings, Food or Drinks with any other student or staff member.

Rescheduling or Cancelling your class(s) *

​Cancellation and Rescheduling Policy: Cancellations must be in writing 48 hours in advance for a class credit to be used for another class. We do not offer refunds. If you fail to notify at least 48 hours in advance of your class, you are not entitled to any rescheduling, or credit. Please note we do not accept verbal notification or last minute personal texts or phone calls to members of staff.

Cancellations beyond our control

PLEASE NOTE during the ongoing crisis, if a class is canceled due to situations beyond our control, for example severe restrictions by the government or further lock-downs, ART 101 will not be issuing any refunds, instead you will be offered the option of transferring to an ONLINE experience. We will also offer you the option of a credit which will be valid for six months from date of purchase and used on any of our upcoming classes or activities, you will also have the option to transfer this credit into a Gift Certificate to gift to someone if you prefer.

I understand that ART 101 might take photographs or videos of art work or work in progress at the studio during classes which may/ or may not be used for publicity purposes. These photos may be published to our social media pages or platforms &/or website, &/or may be posted on other promotional materials or in other promotional media. NO STUDENT will ever be identified in these photographs, no student or student’s work will ever be tagged or named/ identified in any photo without their consent. Please note we archive all our work that is created at our studio, so we take photos for these purposes also. After class, when a project is completed, sometimes we will gather everyone for a group photo, if you do not wish your child to be involved please state this clearly in the special notes section of this form.

All photographs are the property of ART 101 and we do not allow these photos to be published by third party or by any other media or source. We value & are protective of our students always and their interests & privacy.
